Terms of Service

1. AGREEMENT TO TERMS

By accessing or using Prismal Drift ("the Service"), operated by TechSnack, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

3. ELIGIBILITY

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are at least 16 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. ACCOUNT TERMS

You may browse and purchase visualizations without creating an account. If you create an account:

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these terms

5. PAYMENT TERMS

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service.

• Prices are displayed in USD and are subject to change without notice
• You agree to pay all charges incurred by you at the prices in effect when charges are incurred
• We are not responsible for any additional fees charged by your bank or payment provider
• Guest purchases can be linked to an account after creation

6. REFUND POLICY

All sales are final. Due to the digital nature of our products, we do not offer refunds for purchased visualizations or packs.

In exceptional circumstances (such as accidental duplicate purchases or technical issues preventing access), please contact us at support@prismaldrift.com. We will review requests on a case-by-case basis at our sole discretion.

7. USAGE RIGHTS

When you purchase a visualization or pack, you receive a limited, non-exclusive, non-transferable license to:

• Access and view the purchased content for personal, non-commercial use
• Use the content on devices associated with your account

You may NOT:

• Redistribute, resell, or share your purchased content with others
• Record, capture, or create derivative works from the visualizations
• Use the content for commercial purposes without explicit written permission
• Reverse engineer, decompile, or extract the underlying code or assets
• Remove or modify any copyright notices or branding

8. INTELLECTUAL PROPERTY

All content on Prismal Drift, including but not limited to visualizations, shaders, code, graphics, user interface, audio, and text, is the property of TechSnack, LLC and is protected by copyright, trademark, and other intellectual property laws.

The "Prismal Drift" and "Meditate" names, logos, and related marks are trademarks of TechSnack, LLC. You may not use these marks without prior written permission.

9. TERMINATION

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Conduct that is harmful to other users or our business
• Non-payment of fees owed

Upon termination, your right to access purchased content may be revoked. We are not liable for any loss of content or access resulting from termination.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHSNACK, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Personal injury or property damage
• Health effects, including but not limited to seizures, dizziness, or eye strain
• Any damages arising from use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TechSnack, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Wyoming. You consent to the personal jurisdiction of such courts.

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
